A river is defined as ‘a continually or intermittently flowing body of fresh water; and includes a stream and modified watercourse; but does not include an artificial watercourse’.
Activities such as an excavation on a river/stream bed, must be authorised by a resource consent.
Excavation in an artificial watercourse, such as a farm drain, does not need a resource consent.
So, if you are proposing to work in a small watercourse it is very important to know if it is a ‘stream’ or not, and this is sometimes difficult to determine.
